ข้อกำหนดและเงื่อนไข

บทนำ

ยินดีขอต้อนรับท่านสู่เว็บไซต์ Rabbit Selection หรือแอพพลิเคชั่น Rabbit Selection (รวมเรียกว่า “แพลตฟอร์ม”)           ท่านยอมรับและตกลงที่จะผูกผันต่อข้อตกลงและเงื่อนไขต่างๆ ในการใช้บริการ ดังต่อไปนี้
 

 **เพื่อผลประโยช์ของท่านเอง กรุณาอ่านเงื่อนไขและข้อตกลงนี้โดยละเอียด หากท่านไม่เห็นชอบต่อข้อตกลงและเงื่อนไขในการใช้บริการนี้ กรุณาปฎิเสธการเข้าใช้แพลตฟอร์มของเรา
 

1. สมาชิกภาพ

1.1 ก่อนท่านเข้าใช้บริการแพลตฟอร์ม รวมถึงการเข้าร่วมการส่งเสริมการขายและกิจกรรมทางการตลาดของ Rabbit Selection ท่านจะต้องสมัครเป็นสมาชิกก่อนเท่านั้น

1.2  ผู้ใช้งานแต่ละท่านมีสิทธิลงทะเบียนเป็นสมาชิก Rabbit Selection ได้เพียง 1 บัญชีผู้ใช้งาน หาก Rabbit Selection ตรวจสอบพบว่าท่านมีบัญชีผู้ใช้งานมากกว่า 1 บัญชี Rabbit Selection มีสิทธิยกเลิกคำสั่งซื้อและบัญชีผู้ใช้งาน รวมถึงคูปองหรือสิทธิประโยชน์ต่างๆ ที่ได้ให้ไว้หรือถูกใช้ไป

1.3  ท่านจำเป็นต้องให้ข้อมูลที่ถูกต้อง สมบูรณ์และตรงกับความจริง และเป็นปัจจุบันมากที่สุด

1.4  หากมีการเปลี่ยนแปลงใดๆ เกี่ยวกับข้อมูลของท่าน ท่านตกลงที่จะเปลี่ยนแปลงข้อมูลนั้นๆให้ถูกต้องอย่างสม่ำเสมอ

1.5  สำหรับลูกค้าที่เป็นผู้เยาว์ตามประมวลกฎหมายแพ่งและพาณิชย์แห่งราชอาณาจักรไทย ท่านยอมรับว่า การใช้บริการใดๆ บนแพลตฟอร์ม ท่านได้รับความยินยอมจากผู้แทนโดยชอบธรรมแล้ว ก่อนการสมัครเป็นสมาชิกของ Rabbit Selection หากท่านไม่ได้รับความยินยอมจากผู้แทนโดยธรรมของท่าน กรุณาปฎิเสธการเข้าใช้แพลตฟอร์ม

1.6  ท่านยืนยันที่จะเก็บข้อมูลและรหัสผ่านของท่านเป็นความลับ และยอมรับว่าการพยายามเข้าถึง หรือการเข้าถึงโดยไม่ได้รับอนุญาตสู่แพลตฟอร์มหรือบริการอื่นๆ เป็นเรื่องที่ห้ามกระทำ นอกจากนี้ คุณตกลงยินยอมที่จะรับผิดชอบต่อกิจกรรมใดๆที่เกิดขึ้นภายใต้ชื่อบัญชีผู้ใช้งานของท่านเอง

1.7  หากท่านใช้แพลตฟอร์มเพื่อก่อให้เกิดความเสียหายใดๆ ทั้งต่อ Rabbit Section หรือฝ่ายที่เกี่ยวข้องในกรณีใดๆ ก็ตาม ท่านยินยอมที่จะรับผิดชอบค่าเสียหายที่เกี่ยวข้องทั้งทางตรงและทางอ้อมต่อ Rabbit Selection และต่อบุคคลอื่นๆ

1.8  ท่านจะต้องไม่สมัครสมาชิกด้วยเจตนาที่จะกระทำการใดที่ไม่ซื่อสัตย์สุจริต ซึ่งการกระทำใดๆนั้นจะส่งผลต่อ Rabbit Selection หรือบุคคลอื่นๆ

1.9  Rabbit Selection ขอสงวนสิทธิในการระงับบัญชีผู้ใช้งานและการเป็นสมาชิกของท่านชั่วคราวหรือถาวร โดยไม่ต้องแจ้งล่วงหน้า หาก Rabbit Selection ตรวจสอบบัญชีของท่านและพบว่าท่านได้ให้ข้อมูลที่เป็นเท็จ ไม่ถูกต้อง ไม่ครบถ้วนสมบูรณ์ หรือท่านไม่ได้ให้ข้อมูลล่าสุด หรือ ท่านไม่ได้เก็บข้อมูลผู้ใช้และรหัสผ่านของท่านเป็นความลับตนเอง รวมถึงสงวนสิทธิ์ในปฏิเสธการสมัครสมาชิกเพื่อใช้งานของท่านอีกในอนาคต

1.10 Rabbit Selection ขอสงวนสิทธิในการระงับการเป็นสมาชิกของท่าน โดยไม่แจ้งล่วงหน้า หาก Rabbit Selection ตรวจสอบบัญชีของท่านและพบว่า ท่านกระทำการหรืออาจกระทำการใดๆ ที่ขัดต่อกฎหมายแห่งราชอาณาจักรไทย

1.11 Rabbit Selection ขอสงวนสิทธิ์ไม่ให้บริการกับสมาชิกที่เคยถูกตัดสิทธิ์การใช้งานไปแล้ว

1.12 Rabbit Selection อาจมีโปรโมชั่น หรือ รางวัลพิเศษให้แก่สมาชิกของเราเป็นครั้งคราว ในการรับโปรโมชั่นพิเศษดังกล่าวหากสมาชิกผู้ใช้งานท่านใดที่ได้รับรางวัล (จะเป็นของรางวัล เครดิตพิเศษ บัตรของขวัญ คูปอง หรือ ผลประโยชน์อื่นใดที่นอกเหนือไปจากนี้) จาก Rabbit Selection แต่มีการสมัครสมาชิกซ้ำซ้อนเอาไว้ในหลายชื่อ หรือใช้อีเมล์แอดเดรสหลายชื่อ รวมถึง การให้ข้อมูลที่เป็นเท็จ หรือ มีการกระทำอันเป็นการหลอกลวงจะถูกตัดสิทธิในการได้รับรางวัลใดๆในกิจกรรมที่ทางเราได้จัดขึ้นและอาจจะถูกดำเนินคดีตามกฎหมายหรือมีโทษปรับตามกฎหมายอาญา

2. ข้อมูลต่างๆในเนื้อหา ความเป็นเจ้าของ และข้อจำกัดการใช้งาน

ข้อมูลและข่าวสารที่อยู่ในเว็บไซต์นี้ รวมถึง รูปภาพ รูปวาด รูปแบบ ภาพถ่าย คลิป ภาพยนตร์ ข้อความ และเนื้อความสาระอื่นๆ ที่ปรากฏในนี้ (เรียกรวมกันทั้งหมดในที่นี้ว่า “เนื้อหา”) เป็นลิขสิทธิ์ และทรัพย์สินทางปัญญาอื่นๆ ที่ถือสิทธิ์โดย Rabbit Selection  

นอกเหนือจากการเลือกชมและสั่งซื้อสินค้าแล้ว เนื้อหาสาระทั้งหมดไม่สามารถทำซ้ำ คัดลอก แจกจ่าย โฆษณาซ้ำ ดาวน์โหลด เผยแพร่ ทั้งข้อความที่ผ่านทางอิเล็คทรอนิคส์ หรือทางเครื่องกล สื่อสาร บันทึก การทำสำรองอื่นใด การถ่ายเอกสาร หรือการคัดลอกโดยไม่ได้รับการอนุญาตเป็นลายลักษณ์อักษรจาก Rabbit Selection

3. ทรัพย์สินทางปัญญา

1. Rabbit Selection เป็นเจ้าของลิขสิทธิ์ เครื่องหมายการค้า ตราสัญลักษณ์ กู๊ดวิลล์ การออกแบบ สิ่งประดิษฐ์ สิทธิบัตร โลโก้ สโลแกน โนว์ฮาว ข้อมูล ความลับทางการค้า รูปวาด ซอฟต์แวร์ โค้ด หรือส่วนประกอบอื่นๆ ที่ปรากฏในทุกๆหน้าของเว็บไซต์นี้ (รวมเรียกว่า "ทรัพย์สินทางปัญญา") ทั้งที่จดทะเบียนแล้วและยังไม่ได้จดทะเบียน หรืออาจมีสิทธิจะได้จดทะเบียน รวมถึงสิทธิในทรัพย์สินอื่นๆ ที่ทาง Rabbit Selection ใช้หรือพัฒนา

2. ห้ามการกระทำใดๆที่เป็นการละเมิดทรัพย์สินทางปัญญา ไม่ว่าจะเป็นการคัดลอก การทำซ้ำ การดัดแปลง การทำวิศวกรรมย้อนรอย การคัดลอกรหัสคอมพิวเตอร์ การเผยแพร่ข้อมูล การตีพิมพ์ซ้ำ การสร้างเว็บไซต์ลิงค์ใดๆ หรือการกระทำด้วยวิธีการใดๆ ไม่ว่าจะทั้งหมด หรือบางส่วน ต่อทรัพย์สินซึ่งได้รับการคุ้มครอง บนแพลตฟอร์มของ Rabbit Selection

3. ข้อมูลและข่าวสารที่อยู่ในเว็บไซต์นี้ รวมถึง ตัวอักษร รูปภาพ รูปวาด รูปแบบ ภาพถ่าย คลิปวีดีโอ ข้อความ และเนื้อหาดิจิทัลอื่นๆ ไม่ว่าจะถูกเผยแพร่หรือไม่ได้เผยแพร่บนแพลตฟอร์ม (รวมเรียกว่า เนื้อหา”) ถือเป็นลิขสิทธิ์ และทรัพย์สินทางปัญญาของ Rabbit Selection  นอกเหนือจากการเลือกชมและสั่งซื้อสินค้าแล้วนั้น เนื้อหาทั้งหมดไม่สามารถทำซ้ำ คัดลอก แจกจ่าย โฆษณาซ้ำ ดาวน์โหลด เผยแพร่ ทั้งข้อความที่ผ่านทางอิเล็คทรอนิคส์ หรือทางเครื่องกล สื่อสาร บันทึก การทำสำรองอื่นใด การถ่ายเอกสาร หรือการคัดลอกโดยไม่ได้รับการอนุญาตเป็นลายลักษณ์อักษรจาก Rabbit Selection

4. Rabbit Selection มีสิทธิในการปกป้องทรัพย์สินทางปัญญาทั้งหมด ทั้งที่เป็นทรัพย์สินของ Rabbit Selection และบริษัทในเครือ รวมทั้งทรัพย์สินทางปัญญาของของผู้ขาย บนแพลตฟอร์มของ Rabbit Selection

 

4. การเชื่อมโยงกับเว็บไซต์อื่น

ทางบริษัทขอแจ้งให้ผู้ใช้บริการทุกท่านทราบว่า เนื่องจากแพลตฟอร์มของ Rabbit Selection มีการเชื่อมต่อไปยังเว็บไซต์หรือแพลตฟอร์มของผู้ให้บริการอื่น Rabbit Selection จะไม่รับผิดชอบสำหรับนโยบายคุ้มครองข้อมูลส่วนบุคคลของเว็บไซต์อื่น และRabbit Selection ขอแนะนำให้ผู้ใช้บริการทุกท่าน ระมัดระวังเมื่อออกจากแพลตฟอร์ม Rabbit Selection  และโปรดอ่านนโยบายการคุ้มครองข้อมูลส่วนบุคคลของแต่ละแพลตฟอร์มซึ่งมีการรวบรวมข้อมูลส่วนบุคคล นโยบายข้อมูลส่วนบุคคลฉบับนี้ใช้บังคับเฉพาะข้อมูลที่แพลตฟอร์มนี้รวบรวมเท่านั้น

 

5. กฎ กติกา มารยาทในการนำเสนอข้อมูลของผู้ใช้งานแพลตฟอร์ม

Rabbit Selection ไม่รับผิดชอบต่อเนื้อหาใดๆที่ท่านได้ทำการนำเสนอต่อสาธารณชน (ทั้งนี้รวมถึงพื้นที่แสดงความคิดเห็น หน้าข้อมูลต่างๆของแพลตฟอร์ม ช่องแชท หรือพื้นที่สาธารณะใดๆก็ตามที่ปรากฏอยู่ในแพลตฟอร์ม) Rabbit Selection             ไม่จำเป็นต้องเห็นด้วย และไม่มีส่วนเกี่ยวข้องกับเนื้อหาใดๆ (ที่ท่านหรือผู้ใช้งานท่านอื่นแสดงความคิดเห็นขึ้นมา) Rabbit Selection ขอสงวนสิทธิ์ในการใช้ดุลยพินิจที่จะลบเนื้อหาหรือความคิดเห็นของท่านได้โดยไม่ต้องแจ้งให้คุณทราบล่วงหน้า    ถ้าหากเนื้อหาหรือความคิดเห็นนั้นๆมีเจตนาหรือมีข้อสงสัยว่าเป็น

5.1  ข้อความหรือเนื้อหาอันเป็นการทำลายชื่อเสียง หมิ่นประมาท ส่อเสียด คุกคาม ว่ากล่าวให้ร้ายแก่สมาชิกท่านอื่นหรือบุคคลที่สาม

5.2  การนำเสนอ เผยแพร่ ข้อความหรือเนื้อหาที่เป็นการนำเสนอที่ส่อไปในทางลามก อนาจารหรือขัดต่อกฎหมายใดๆ

5.3  การเผยแพร่หรืออัพโหลดไฟล์ข้อมูลที่มีไวรัส ไฟล์ที่ส่งผลให้เกิดการทำงานที่ไม่ปกติ หรือ ซอฟท์แวร์ หรือโปรแกรมใดๆที่อาจก่อให้เกิดความเสียหายต่อการทำงานของแพลตฟอร์ม และ/หรือระบบคอมพิวเตอร์ รวมถึงระบบเครือข่ายของบุคคลที่สาม

5.4  ข้อความหรือเนื้อหาที่เป็นการละเมิดลิขสิทธิ์หรือเครื่องหมายการค้า ที่เป็นการผิดกฎหมายของราชอาณาจักรไทยหรือ นานาประเทศ รวมถึงการละเมิดลิขสิทธิ์ทรัพย์สินทางปัญญาของ Rabbit Selection หรือบุคคลที่สาม

5.5  การนำเสนอข้อความหรือเนื้อหาที่เป็นการโฆษณา หรือเนื้อหาที่เป็นการประชาสัมพันธ์อันมีเจตนาเพื่อจะกระตุ้นให้เกิดการซื้อสินค้า

6. ราคา และ รายละเอียดผลิตภัณฑ์

6.1  Rabbit Selection จะพยายามแสดงราคาและรายละเอียดของผลิตภัณฑ์ที่ปรากฏบนแพลตฟอร์มที่ถูกต้องและแม่นยำมากที่สุดเท่าที่จะทำได้ หาก Rabbit Selection พบข้อผิดพลาดเกี่ยวกับราคาผลิตภัณฑ์ซึ่งท่านได้สั่งซื้อเข้ามา ทาง Rabbit Selection จะแจ้งให้ท่านทราบโดยเร็ว

6.2  Rabbit Selection พยายามจะอธิบายและให้คำอธิบายของผลิตภัณฑ์ที่ถูกต้องแม่นยำที่สุดเท่าที่จะทำได้ ท่านยอมรับและเห็นชอบว่าการเข้าใช้งานอาจมีความคลาดเคลื่อนของข้อมูล หากท่านพบว่ารายละเอียดผลิตภัณฑ์ไม่ตรงกับผลิตภัณฑ์จริง หรือเกิดกรณีสินค้ามีความชำรุดบกพร่อง ท่านสามารถดำเนินการเพื่อรับบริการหลังการขายตามนโยบายการรับคืนผลิตภัณฑ์ของ Rabbit Selection โดยมีรายละเอียดดังต่อไปนี้

       (1)   หากสินค้ามีปัญหาสามารถเปลี่ยนสินค้าใหม่ได้ทันทีภายใน 7 วัน หลังจากได้รับสินค้า (ในที่นี้จะต้องเข้าเงื่อนไข คือ สินค้ามีการชำรุดเสียหายจากโรงงานหรือการผลิตเท่านั้น จะไม่รวมถึงการนำไปใช้งานโดยผิดวัตถุประสงค์หรือผิดวิธี)     ซึ่งฝ่ายบริการหลังการขายของ Rabbit Selection จะทำการตรวจเช็คสินค้าที่ส่งคืนมาว่าเป็นเข้าตามเงื่อนไขข้างต้นหรือไม่ โดยหากเข้าเงื่อนไขดังกล่าว ท่านจะได้รับสินค้าใหม่ภายใน 14 วัน และหากไม่เข้าเงื่อนไขดังกล่าว ทาง Rabbit Selection จะส่งคืนสินค้าตัวเดิมกลับไปยังท่านอีกครั้ง

(3)   กรณีที่ต้องการคืนสินค้าและคืนเงิน ทาง Rabbit Selection ขอสงวนสิทธิ์ในการใช้ดุลยพินิจพิจารณาเป็นกรณีๆไป             แต่อย่างไรก็ตาม สินค้าจะต้องอยู่ในสภาพสมบูรณ์เท่านั้น ตลอดจนไม่มีการแกะกล่องสินค้าหรือเปิดใช้งานใดๆ ทั้งสิ้น โดยระยะเวลาในการทำเรื่องคืนเงินอยู่ที่ประมาณ 14 วันทำการนับแต่ Rabbit Selection พิจารณาแล้วว่าสินค้าอยู่ในเงื่อนไขที่ได้รับการคืนเงิน

(4)   กรณีหากมีการแกะกล่องสินค้าหรือเปิดใช้งานสินค้าไปแล้วและพบว่าสินค้าดังกล่าวไม่สามารถใช้งานได้               ทาง Rabbit Selection ขอสงวนสิทธิ์ในการจะเปลี่ยนเป็นสินค้าตัวใหม่ให้เท่านั้น 

(5)   กรณีหากได้รับสินค้าที่ไม่ตรงตามคำสั่งซื้อ ให้ท่านแจ้งมายัง Rabbit Selection ผ่านทางกล่องข้อความแชท พร้อมทั้งส่งหลักฐานการสั่งซื้อและตัวสินค้าที่ได้รับ โดยทาง Rabbit Selection จะพิจารณารายละเอียดเพื่อดำเนินการเปลี่ยนสินค้าให้เป็นตัวที่ถูกต้องตามคำสั่งซื้อให้แก่ท่านภายใน 14 วัน   

(6)   Rabbit Selection ขอสงวนสิทธิ์ในการไม่รับคืนสินค้าในทุกกรณี หากลูกค้ามีการสั่งซื้อสินค้าที่ผิดสี ผิดรุ่นอันเกิดจากความเข้าใจผิดหรือคลาดเคลื่อนของตัวลูกค้าเอง

(7)   กรณีหากต้องการเคลมสินค้าที่มีตำหนิ ลูกค้าจะต้องเก็บกล่องสินค้าและ/หรืออุปกรณ์ทุกชิ้นรวมถึงใบเสร็จรับเงิน      ที่อยู่ในสภาพสมบูรณ์ เพื่อใช้ในการเคลมทุกครั้งทุกกรณี

6.3  Rabbit Selection พยายามแสดงสีของผลิตภัณฑ์ และรายละเอียดอื่นๆของผลิตภัณฑ์ให้แม่นยำและสอดคล้องกับรายละเอียดของผลิตภัณฑ์จริงให้ได้มากที่สุด อย่างไรก็ตาม เนื่องจากประสิทธิภาพการอ่านสีบนจอภาพล้วนแตกต่างกันไปตามแต่รุ่นของหน้าจอ ซึ่งนั่นอาจทำให้สีของผลิตภัณฑ์มีความแตกต่างจากความเป็นจริง      

6.4  หากท่านมีคำถามที่เกี่ยวข้องกับ ราคาของผลิตภัณฑ์ รายละเอียดของผลิตภัณฑ์ กรุณาติดต่อศูนย์บริการลูกค้าของ Rabbit Selection ผ่านช่องทางดังต่อไปนี้

7. การยกเลิกคำสั่งซื้อ

ท่านยอมรับว่า Rabbit Selection มีสิทธิ์ในการยกเลิกคำสั่งซื้อของท่านได้ หากเกิดความผิดพลาดที่มิได้มีการคาดการณ์ไว้ล่วงหน้า และเป็นผลให้สินค้าในแพลตฟอร์มมีการลงรายการไว้ไม่ถูกต้อง (ไม่ว่าจะเป็นการลงราคาผิด หรือ ลงรายละเอียดที่ผิด เป็นต้น) โดยหากเป็นกรณีที่ Rabbit Selection ได้รับการชำระเงินสำหรับคำสั่งซื้อนั้นเสร็จสมบูรณ์เรียบร้อยแล้ว ทาง Rabbit Sเelection จะทำการคืนเงินให้ท่านเต็มจำนวนราคาสินค้า     

 

8. การคุ้มครองผู้บริโภค

8.1  เนื่องจาก Rabbit Selection มีผลิตภัณฑ์บางประเภทที่มีประกันมาพร้อมกับการซื้อผลิตภัณฑ์ ท่านสามารถดูข้อมูลเกี่ยวกับการประกันนั้นๆได้ที่หน้าลิงค์ของสินค้านั้นๆ

8.2  ตามเงื่อนไขของบริการหลังขาย หากท่านไม่พึงพอใจ ท่านสามารถดำเนินการเพื่อรับบริการหลังการขาย เพื่อขอรับเงินคืน ขอเปลี่ยน หรือซ่อมแซมผลิตภัณฑ์โดยปฎิบัติตามนโยบายการของ Rabbit Selection

 

9. การระงับการใช้งาน

 9.1 หาก Rabbit Selection ตรวจพบการทุจริตหรือการกระทำผิดกฎหมายใดๆ ทาง Rabbit Selection มีสิทธิที่จะระงับการให้บริการหรือยกเลิกคำสั่งซื้อได้

9.2  ท่านต้องไม่ใช้แพลตฟอร์มในทางมิชอบ ท่านต้องไม่ก่อหรือช่วยเหลือการก่ออาชญากรรม โอนหรือเผยแพร่ไวรัส รวมถึง ม้าโทรจัน วอร์ม โลจิกบอม หรือโปรแกรมอื่นๆ ที่มีวัตถุประสงค์ที่เป็นอันตรายต่อเทคโนโลยี ไม่เผยแพร่ข้อมูลหรือเนื้อหาที่มีลักษณะลามกอนาจาร เจตนาทำลายชื่อเสียง หมิ่นประมาท หยาบคาย มุ่งร้าย ลามกอนาจาร ส่อไปในทางเรื่องเพศ หรือขัดต่อกฎหมายใดๆที่บังคับใช้ ตลอดจนไม่ลักลอบเข้าระบบหรือคลังข้อมูล หรือการกระทำใดๆ ที่ใช้แพลตฟอร์มของ Rabbit Selection ในทางที่ขัดต่อเจตนาและจุดมุ่งหมายของ Rabbit Selection ทั้งนี้ หากการะทำดังกล่าวของท่าน ทำให้ Rabbit Selection ทาง หรือ บุคคลภายนอกได้รับความเสียหาย ไม่ว่าจะทางตรงหรือทางอ้อม ท่านจะต้องเป็นผู้รับผิดชอบต่อความเสียหาย หรือค่าเสียหายที่เกิดขึ้นต่อ Rabbit Selection  หรือบุคคลภายนอกทั้งปวง

9.3  หากมีการใช้แพลตฟอร์ม ในทางมิชอบในกรณีใดๆ ที่ถือว่าเป็นการกระทำที่ผิดกฎหมายอาญา หรือกฎหมายอาชญากรรมทางคอมพิวเตอร์แห่งราชอาณาจักรไทย หรือกฎหมายใดๆ ที่เกี่ยวข้อง ทาง Rabbit Selection จะรายงานการกระทำที่มิชอบนั้นๆ ต่อหน่วยงานที่รับผิดชอบและเกี่ยวข้องเพื่อดำเนินการทางกฎหมายต่อไป

9.4  Rabbit Selection ขอสงวนสิทธิในการใช้ดุลพินิจในการระงับหรือยกเลิกรายการสั่งซื้อหรือบัญชีผู้ใช้งานที่มีการกระทำ    มิชอบ ผิดสัญญา หรือมีส่วนต้องสงสัยที่จะมีการกระทำที่ผิดตามกฎหมาย

9.5  Rabbit Selection ขอสงวนสิทธิในการใช้ดุลพินิจในการระงับ ยกเลิก หรือเปลี่ยนแปลงรายการสั่งซื้อหรือยกเลิกสิทธิพิเศษอื่นๆที่มีการกระทำอันเข้าข่ายดังต่อไปนี้

1. รายการสั่งซื้อที่ต้องสงสัยหรือมีการทุจริต

2. รายการสั่งซื้อที่ใช้ข้อมูลที่ถูกโจรกรรม

3. รายการสั่งซื้อของหลายบัญชีผู้ใช้ แต่โดยลูกค้าคนเดียวกัน หรือกลุ่มกลุ่มลูกค้าเดียวกัน

4. รายการสั่งซื้อที่มีเจตนาเพื่อที่จะนำไปขายต่อ

5. Rabbit Selection มีสิทธิใช้ดุลพินิจในการใช้เงื่อนไขตามข้อ 9.3, 9.4 และ 9.5 โดยไม่ต้องบอกก่อนล่วงหน้า

10. การรับประกัน

ไม่ว่าในกรณีใดๆ Rabbit Selection ไม่ขอรับประกัน รับรอง หรือเป็นตัวแทน ต่อการนำเสนอเนื้อหาของผู้ใช้งาน หรือความคิดเห็น คำแนะนำ หรือคำรับประกันใดๆที่ปรากฏ (ไม่ว่าจะแจ้งไว้อย่างชัดเจนหรือบอกเป็นนัยยะทางกฎหมายก็ตามที)           ในแพลตฟอร์มของเรา โดยหมายรวมถึงข้อมูลส่วนตัวของท่านที่มีการนำเข้าหรือส่งผ่านระบบของเราด้วย (หากมี)

 

11. ข้อจำกัดความรับผิด

ท่านเข้าใจอย่างชัดเจนและตกลงเป็นดังนี้ : ข้อความ และสาระสำคัญในแพลตฟอร์มอาจมีความไม่ถูกต้อง ในส่วนของเนื้อหาสาระ และคำสะกด การเชื่อถือข่าวสารดังกล่าวอยู่ในส่วนความรับผิดชอบของตัวท่านเอง ขอสงวนสิทธิ์ในการแก้ไขข้อผิดพลาด หรือความไม่ครบถ้วนในส่วนต่างๆ ในแพลตฟอร์มนี้ไม่ว่าจะเป็น เนื้อหาสาระ รายละเอียดและข้อมูลสินค้า โปรแกรมการบริการ และราคาที่ได้แสดงไว้ในแพลตฟอร์มนี้ อาจมีการเปลี่ยนแปลงโดยไม่แจ้งให้ทราบล่วงหน้า

กรุณากรอกรายละเอียดและข้อมูลต่าง ๆ เพื่อลงทะเบียน (Register) ในการใช้บริการบนแพลตฟอร์ม โดยท่านต้องกำหนด รหัสประจำตัว (Password) ด้วยตัวของท่านเอง และต้องเก็บรักษารหัสประจำตัว (Password) ดังกล่าวไว้เป็นความลับ

การสั่งซื้อสินค้าและบริการหรือการกระทำรายการใดๆ ที่เกิดขึ้นบนแพลตฟอร์ม ไม่ว่าจะเป็นการกระทำด้วยตัวของท่านเอง หรือการที่ท่านมอบหมายให้ผู้หนึ่งผู้ใด หรือบุคคลอื่นนำรหัสประจำตัว(Password) ของท่านไปใช้ หรือ มีบุคคลอื่นแอบอ้างนำรหัสประจำตัว (Password) ของท่านมาใช้ในการสั่งซื้อสินค้า และบริการหรือกระทำรายการใดๆ ไม่ว่าจะเป็นไปโดยความตั้งใจของท่าน หรือเกิดจากความประมาทเลินเล่อของท่าน ให้ถือว่าการกระทำดังกล่าวถูกต้องสมบูรณ์ หากมีความเสียหายใดๆ เกิดขึ้น ไม่ว่าจะด้วยเหตุใดก็ตาม ท่านในฐานะเจ้าของรหัสประจำตัว (Password) จะยังคงต้องรับผิดชอบในการกระทำดังกล่าวทั้งหมดทุกประการ โดยไม่มีข้อโต้แย้งหรือข้อเรียกร้องใดๆ เพื่อให้บริษัทต้องรับผิดชอบชดใช้ค่าเสียหายแทนท่าน      แต่ประการใด

ภายใต้ข้อตกลงและเงื่อนไขในการใช้บริการบนแพลตฟอร์มนี้ หากท่านนำบัตรเครดิตของผู้อื่นมาทำรายการชำระค่าสินค้า หรือค่าบริการต่างๆ โดยที่ท่านไม่ได้รับอนุญาตจากเจ้าของบัตรเครดิต รวมถึงการชำระค่าสินค้าหรือค่าบริการที่ไม่ถูกต้องหรือไม่ตรง หรือไม่เป็นไปตามเจตนาที่แท้จริงของเจ้าของบัตรเครดิต เมื่อ Rabbit Selection ได้รับการโต้แย้งจากเจ้าของบัตรเครดิต หรือจากธนาคารผู้ออกบัตรเครดิต ทำให้ Rabbit Selection ไม่ได้รับชำระค่าสินค้าหรือค่าบริการ หรือไม่สามารถเรียกเก็บเงินค่าใช้บริการจากเจ้าของบัตรเครดิต หรือจากธนาคารผู้ออกบัตรเครดิตได้ ท่านในฐานะผู้ใช้บริการ จะต้องรับผิดชอบค่าสินค้าหรือค่าบริการ และค่าเสียหายต่างๆ ที่เกิดขึ้นทุกประการ และไม่ตัดสิทธิ Rabbit Selection ในการดำเนินคดี กับท่านตามกฎหมายต่อไป

Rabbit Selection ขอสงวนสิทธิ์ในการแก้ไขเปลี่ยนแปลงข้อตกลง และเงื่อนไขดังกล่าวข้างต้นได้ตลอดระยะเวลาการให้บริการ การที่ท่านยังคงใช้แพลตฟอร์มนี้หลังจากมีการเปลี่ยนแปลงข้อตกลง และเงื่อนไขดังกล่าวแล้ว จะถือว่าท่านได้ยอมรับการเปลี่ยนแปลงดังกล่าวแล้ว

 

12. การชดเชยค่าเสียหาย

ผู้ใช้งานยอมรับที่จะชดเชยค่าเสียหาย และค่าใช้จ่ายอันเกิดจากการละเมิดเงื่อนไขและข้อกำหนดในการให้บริการหรือการกระทำอื่นใดที่เกี่ยวข้องกับบัญชีผู้ใช้งานของสมาชิก อันเนื่องมาจากการละเลยหรือการกระทำที่ผิดกฎหมาย

 

13. การใช้งานเว็บไซต์

 Rabbit Selection มิได้รับรอง รับประกัน หรือ เป็นตัวแทนของข้อมูล เนื้อหาใดๆที่ปรากฏบนหน้าแพลตฟอร์ม ซึ่งอาจนำไปใช้เพื่อขอบเขตทางกฎหมายของประเทศอื่นใด (นอกเหนือจากประเทศไทย) เมื่อท่านเข้ามาที่แพลตฟอร์มของเรา ถือว่าท่านได้รับรู้และหมายถึงการแสดงตนต่อ Rabbit Selection แล้วว่า ท่านมีสิทธิตามกฎหมายในการทำเช่นนั้นและให้ใช้ข้อมูลเหล่านั้นได้ในแพลตฟอร์มของเรา

 

14. บททั่วไป

14.1   ข้อตกลงทั้งหมด: เงื่อนไขการให้บริการของแพลตฟอร์มทั้งหมดนี้เป็นข้อตกลงเบ็ดเสร็จและเด็ดขาดระหว่างท่านและ  Rabbit Selection ซึ่งการที่ท่านเข้ามาใช้งานแพลตฟอร์ม ทั้งท่านและ Rabbit Selection มิได้ถูกผูกมัด หรือแสดงนัยยะถึงการเป็นตัวแทน การรับรอง หรือสัญญาใดๆต่อกันหากที่ไม่ได้แสดงไว้ในที่นี้ เว้นแต่จะมีการระบุไว้เป็นพิเศษ ข้อกำหนดและเงื่อนไขในการให้บริการของแพลตฟอร์มของเราเป็นฉบับปัจจุบันที่ถือเป็นฉบับล่าสุด และใช้แทนที่ทุกข้อตกลง ข้อรับรอง      การดำเนินการใดๆ ที่มีมาก่อนหน้านี้ ไม่ว่าจะเป็นลายลักษณ์อักษรหรือโดยวาจา ระหว่างท่านและ Rabbit Selection ที่เกี่ยวข้องกับการที่คุณใช้งานแพลตฟอร์มของเรา 

14.2    การเปลี่ยนแปลงแก้ไข: Rabbit Selection  อาจมีการเปลี่ยนแปลง แก้ไขข้อกำหนด และ เงื่อนไขเหล่านี้ได้ทุกเวลา ท่านรับทราบและตกลงว่า การเข้าเยี่ยมชมแพลตฟอร์มของเราในแต่ละครั้ง ถือว่าคุณตกลงยินยอมต่อข้อกำหนดและเงื่อนไขที่ได้รับการแก้ไขล่าสุดแล้ว และถึงแม้ว่าการเปลี่ยนแปลงแก้ไขข้อกำหนดและเงื่อนไขครั้งล่าสุดจะมิได้มีการระบุไว้ก็ตามที แต่ให้ยึดเอาข้อกำหนดและเงื่อนไขฉบับปัจจุบันเป็นสำคัญ การเข้าเยี่ยมชมแพลตฟอร์มของท่านในแต่ละครั้ง จะต้องถือเอาข้อกำหนดและเงื่อนไขล่าสุดเป็นสำคัญ และเป็นความรับผิดชอบของท่านเองที่ควรจะเยี่ยมชมหน้าข้อกำหนดและเงื่อนไขล่าสุดของแพลตฟอร์มเป็นระยะๆ เพื่อให้ทราบถึงเนื้อหาล่าสุด

14.3    ความขัดแย้ง: กรณีที่มีการกำหนดข้อตกลงและเงื่อนไขการใช้บริการในหน้าอื่นที่กำหนดไว้เป็นพิเศษ ขัดหรือแย้งกับข้อตกลงและเงื่อนไขการใช้บริการนี้ ให้ท่านถือปฏิบัติตามข้อตกลงและเงื่อนไขการใช้บริการที่ปรากฏในหน้าอื่นนั้นอย่างเป็นกรณีพิเศษก่อน และข้อกำหนดข้อนั้นจะถือว่าแยกออกจากข้อกำหนดเหล่านี้และไม่มีผลกระทบต่อการมีผลใช้บังคับของข้อตกลงที่เหลือนี้

14.4    การถือครองสิทธิ์ : Rabbit Selection มีสิทธิขาดในการให้ โอน หรือมอบสิทธิหรือภาระผูกพันใดไม่ว่าทั้งหมดหรือบางส่วนที่เกี่ยวข้องเงื่อนไขการให้บริการ นโยบายและประกาศใดๆที่เกี่ยวข้องกันก็ตาม ให้แก่ตัวแทนหรือบุคคลที่สามก็ได้

14.5    การเป็นโมฆะเป็นบางส่วน : ข้อกำหนดและเงื่อนไขในการให้บริการ นโยบาย และประกาศใดๆก็ตามที่เกี่ยวเนื่องกัน จะมีการบังคับใช้เป็นอิสระจากกัน หากมีข้อกำหนดใดของเงื่อนไขในการให้บริการ นโยบาย หรือประกาศ ไม่สามารถใช้บังคับได้ ไม่ว่าจะเป็นโมฆะ ไม่ชอบด้วยกฎหมาย หรือด้วยเหตุผลอื่นใดก็ตาม หรือหากศาลหรือเขตอำนาจศาลใดพิจารณาว่า ข้อกำหนดหรือเงื่อนไขดังกล่าวนั้นไม่สามารถใช้บังคับได้ ให้ใช้ข้อกำหนดหรือเงื่อนไข นโยบายหรือประกาศอื่นใดที้เหลือนอกเหนือจากข้อนั้นๆ เท่าที่สามารถจะใช้ได้ และมีผลบังคับใช้ต่อไป

14.6    กฎหมายที่บังคับใช้ :  ข้อตกลงนี้อยู่ภายใต้กฎหมายแห่งราชอาณาจักรไทย โดยไม่คำนึงถึงความขัดแย้งของหลักกฎหมาย ท่านตกลงว่า ข้อโต้แย้งหรือข้อเรียกร้องที่เกิดขึ้นจาก หรือที่เกี่ยวข้องกับเงื่อนไขและข้อตกลงนี้จะได้รับการแก้ไขภายใต้เขตอำนาจศาลไทยเท่านั้น

 

15. การคืนและการยกเลิกคำสั่งซื้อ

คำสั่งซื้อสามารถจะทำการยกเลิกได้ หากสินค้ายังมิได้ทำการจัดส่ง แต่หากเป็นกรณีที่สินค้าได้ทำการจัดส่งไปแล้ว ท่านจะไม่สามารถทำการยกเลิกคำสั่งซื้อนั้นได้ การขอคืนเงินหลังการสั่งซื้อและรับสินค้าแล้วนั้น จะมีการพิจารณาเป็นกรณีๆไป             ซึ่งโดยทั่วไปเราจะไม่มีนโยบายการคืนเงิน เว้นแต่จะเป็นกรณีที่เกิดการผิดปกติในการสั่งซื้อ อย่างไรก็ดี เราจะพยายามรักษาผลประโยชน์ให้แก่สมาชิกอย่างสูงสุด

 

16. นโยบายการชำระเงิน

ท่านสามารถชำระค่าสินค้า และค่าบริการ(หากมี) ที่สั่งซื้อจากแพลตฟอร์มผ่านบัตรเครดิต (Credit Card) หรือบัตรเดบิต (Debit Card) หรือชำระผ่านระบบ Mobile Banking ของธนาคารต่างๆ ดังที่ระบุไว้ด้านล่าง โดยจะต้องชำระภายใน 48  ชม. เมื่อทำการสั่งซื้อหากเลือกชำระผ่านรูปแบบข้างต้น ทั้งนี้ ระบบจะทำการตรวจสอบการชำระเงินของท่านโดยอัตโนมัติ และอนุมัติการซื้อสินค้าพร้อมกับจัดส่งสินค้าเมื่อการชำระเงินเสร็จสมบูรณ์เท่านั้น

นอกจากนี้ ท่านยังสามารถเลือกชำระค่าสินค้าด้วยรูปแบบการชำระปลายทางด้วยเงินสด (Cash On Delivery) เพิ่มเติมได้อีกช่องทางหนึ่ง โดยท่านจะต้องชำระเงินสดในทันทีที่สินค้าส่งไปยังที่อยู่ที่ท่านให้ไว้สำหรับการจัดส่ง จึงจะถือว่าท่านได้ชำระค่าสินค้าโดยสมบูรณ์และได้รับสินค้าตามที่สั่งซื้อไว้

หมายเหตุ:

• ค่าใช้จ่าย หรือค่าธรรมเนียมโอนเงิน ผู้โอนเงิน/ลูกค้า เป็นผู้รับผิดชอบชำระค่าธรรมเนียมดังกล่าว และ ธนาคารจะใช้เวลาดำเนินการประมาณ 1 วันทำการในการสรุปยอดชำระค่าบริการของท่าน

• กรณีที่ท่านสั่งซื้อสินค้าประเภทที่ต้องมีการติดตั้ง และสินค้านั้นไม่ได้รวมบริการติดตั้งไว้ จะมีค่าใช้จ่ายในการติดตั้งเพิ่มเติม ซึ่งท่านจะต้องชำระค่าติดตั้งดังกล่าวกับเจ้าหน้าที่

 

17. นโยบายการล้างข้อมูลในตระกร้า (หรือรถเข็นสินค้า)

 ข้อมูลสินค้าที่ท่านได้ใส่ไว้ในในตระกร้า (รถเข็น) จะถูกลบโดยอัตโนมัติ เมื่อสินค้านั้นถูกลบจากรายการสินค้าที่มีจำหน่ายบนแพลตฟอร์ม เหตุผลอันเนื่องมากจากแพลตฟอร์มต้องทำการอัพเดตข้อมูลสินค้ารวมไปถึงราคาสินค้า เพื่อให้คุณได้ข้อมูลที่ถูกต้อง แม่นยำ ตรงกับความเป็นจริงที่สุด

Welcome to the Rabbit Selection’s Website or the Rabbit Selection’s Application (which will be called together as, a “platform”). You accept and agree to bind the terms and conditions of service as follows:

1. Membership

1. Before accessing the platform and participating in the sales promotion and marketing activities of the Rabbit Selection, you must apply for the membership first.

2. Each user has the right to register as a membership with the Rabbit Selection for 1 user account only. If the Rabbit Selection has found that you have more than 1 user account, the Rabbit Selection has the right to cancel the purchase order and the user account, including coupons or benefits that are given or used.

3. You must provide the correct and complete information that corresponds to the fact and the present time as much as possible.

4. If there are any changes regarding your information, you agree to change the said information correctly and regularly.

5. For minor customers, according to the Civil and Commercial Code of the Kingdom of Thailand, you accept that by using any services on the platform, you have received consent from the legal representative before applying for the membership with the Rabbit Selection. If you do not receive consent from your legal representative, please deny access to the platform.

6. You confirm to keep your information and password confidential and accept that trying to access or accessing the platform or other services without permission is prohibited. Moreover, you agree to be responsible for any activities that occur under the name of your user account.

7. If you use the platform to cause any damages to the Rabbit Selection or relevant parties in any cases, you give consent to be responsible for the damages that are relevant whether directly or indirectly to the Rabbit Selection and other individuals.

8. You must not apply for membership with the intention to perform dishonest actions that will affect the Rabbit Selection or other individuals.

9. Rabbit Selection reserve the right to suspend your user account and membership temporarily or permanently without prior notice if the Rabbit Selection examines your user account and finds that you have given the false, incorrect, or incomplete information or you do not give the latest information or you do not keep your user information and password in confidentiality and also reserves the right to deny your application for membership in the future.

10. Rabbit Selection reserve the right to suspend your membership without prior notice if the Rabbit Selection examines your account and finds that you perform or might perform any illegal actions against the Kingdom of Thailand.

11. Rabbit Selection reserve the right to not provide the service to disqualified members.

12. Rabbit Selection might have promotions or special rewards for our members at intervals. To receive the special promotions, any users who receive the reward (whether they are rewards, special credits, gift cards, coupons, or other benefits in addition to this) from Rabbit Selection, but have duplicate memberships in several names or use several e-mails as well as giving false information or performing any deceptive acts will be disqualified from receiving any rewards in the activities that we have arranged and might be prosecuted or received the penalty charge according to the criminal law.

 

2. Information in the Content, Ownership, and Restriction of Use

The information and news on this website, including pictures, drawings, patterns, photos, video clips, movies, statements, and other messages shown (Which will be called together as “content”) are the copyright and the intellectual property held by the Rabbit Selection.

Apart from looking at and ordering the products, all contents cannot be duplicated, copied, distributed, re-advertised, downloaded, publicized via electronics or mechanics, communicated, recorded, created a backup, photocopied, or copied without receiving the permission in writing from the Rabbit Selection.

 

3. Intellectual Property

1. Rabbit Selection is the owner of copyrights, trademarks, marks, goodwill, designs, inventions, patents, logos, slogans, know-how, information, trade secrets, drawings, software, codes, or other components shown on every page of this website (Which will be called together as “intellectual property) whether registering and not registering or might have the chance to register, including the right in other properties that the Rabbit Selection uses or develops.

Do not perform any actions that violate the intellectual property whether they are copying, duplicating, modifying, reverse engineering, copying of computer code, publicizing, reprinting, creating any website links, or performing any actions by any methods whether as a whole or some parts to the protected property on the platform of the Rabbit Selection.

3. The information and news on this website, including letters, pictures, drawings, patterns, photos, and other digital content whether they are publicized or not publicized on the platform (Which will be called together as “content”) are considered to be the copyright and the intellectual property of the Rabbit Selection. Apart from looking at and ordering the products, all contents cannot be duplicated, copied, distributed, re-advertised, downloaded, publicized via electronics or mechanics, communicated, recorded, created backup, photocopied, or copied without receiving the permission in writing from the Rabbit Selection.

4. Rabbit Selection have  the right to protect all intellectual properties that belong to the Rabbit Selection and its affiliations, including the intellectual properties of the sellers on the Rabbit Selection’s platform.

 

4. Link to Other Websites

The Company would like to inform all customers that since the Rabbit Selection’s platform is linked to the website or the platform of other service providers, the Rabbit Selection will not be responsible for the personal data protection policy of other websites. Also, the Rabbit Selection would like to suggest all customers to be careful when leaving the Rabbit Selection’s platform and please read the personal data protection policy of each platform that gathers the personal data. This personal data protection policy will be enforced on the information gathered by this platform only.

 

5. Rules, Regulations, and Etiquettes of Information Presentation of the Platform User

Rabbit Selection does not need to agree and does not take part in any content (that you or other users have commented). 1. Statements or contents that defame, libel, instigate, threaten, or slander other members or third parties

2. Presentation or publications of statements or contents that are presented in an obscene, indecent, or illegal manner

3. Publication or uploading of files with viruses, malfunctioning files, or software or any programs that might cause the damage to the work of the platform and/or the computer system, including the network system of the third parties

4. Statements or contents that violate the copyrights or trademarks, are illegal in the Kingdom of Thailand or of foreign countries, and violate the copyright of the intellectual property of the Rabbit Selection or the third parties

5. Presentation of statements or advertising contents or public relations content with the intention to stimulate the purchase.

6. Product Price and Detail

1. Rabbit Selection will try to show the correct and accurate product price and detail shown on the platform as much as possible. If the Rabbit Selection finds the mistakes about the price of the product that you have ordered, the Rabbit Selection will inform you instantly.

2. Rabbit Selection will try to explain and provide the product detail as accurately as possible. You accept and agree that the access might obtain the deviation of information. If you find that the product detail has not corresponded with the actual product or if the product has a defect, you can proceed to receive the after-sales service according to the product return policy of the Rabbit Selection. The details are as follows:

1. If the product has problems, change within 7 days after receiving the product (In this place, it must meet the condition in which the product must be damaged from the factory or the production only, which will not include the misuse or the misapplication.) The after-sales service of the Rabbit Selection will check the returned product whether it meets the abovementioned condition or not. If it meets the said condition, you will receive the new product within 14 days. If it does not meet the said condition, the Rabbit Selection will return the same product to you.

2. In case of need to return the product and getting a refund, the Rabbit Selection reserves the right to use its discretion for consideration case by case. However, the product must be in perfect condition. Also, the product must not be unboxed or opened in any way. The period for refunding is about 14 working days as the Rabbit Selection has considered that the product is in the refund condition.

3. In case the product is unboxed or opened and it is found that the said product cannot be used, the Rabbit Selection reserves the right to change the product only.

4. In case the product received does not match with the purchase order, notify the Rabbit Selection via the inbox and send the proof of purchase order and the product received. Rabbit Selection will consider the details in order to change the correct product within 14 days.

5. Rabbit Selection reserves the right to not accept the returned product in all cases if the customer has ordered the product in the wrong color or model due to a misunderstanding or the fault of the customer.

6. In case of needing to claim the defective product, the customer must keep the box and/or all parts, including the receipt in the perfect condition for claiming at all times in all cases.

6.3       Rabbit Selection tries to show the product color and other product details to be accurate and correspond to the actual product details as much as possible. However, due to the differences in the efficiency of color reading on each screen in each model, the product color might have differed from the reality.

7. Cancellation of Purchase Order

You accept that the Rabbit Selection has the right to cancel your purchase order. In case the expected mistake has occurred and caused the product in the platform to be recorded wrongly (whether it is the record of the wrong price or wrong details) and the Rabbit Selection has already received the full payment, the Rabbit Selection will give the full refund.

 

8. Consumer Protection

8.1       Since some types of the Rabbit Selection’s products come with the warranty, you can look at the information on the said warranty on the link page of the said product.

8.2       According to the conditions of after-sales service, if you feel unsatisfied, you can proceed to receive the after-sales service to request for a refund, change, or reparation by complying with the Rabbit Selection’s policy.

 

9. Suspension of Use

9.1       If the Rabbit Selection detects any corruption or illegal actions, the Rabbit Selection reserves the right to suspend the service or cancel the purchase order.

9.2       You must not use the platform in an illegal manner. You must not cause or support the crime or transfer or spread the virus, including Trojan horse, WORM, logic bomb, or other programs that are harmful to the technology. Do not publicize the information or the contents that are obscene, intent to discredit, rude, baleful, indecent, sexual, or contradictory to any laws that are enforced. Also, do not hack into the system or the data warehouse or perform any actions that involve the use of the Rabbit Selection’s platform in a way that contradicts the intention and the objective of the Rabbit Selection. Hence, if your action has caused the damages to the Rabbit Selection or the third parties whether directly or indirectly, you must be responsible for the losses or damages that might occur to the Rabbit Selection or the third parties entirely.

9.3       If the platform is used in an illegal manner in any cases that are considered to be against the criminal law or the computer crime act of the Kingdome of Thailand or any relevant laws, the Rabbit Selection will report the said illegal actions to the relevant agencies in charge for a further legal proceeding.

9.4       Rabbit Selection reserves the right to use its discretion to suspend or cancel the purchase order or the user account that involves the illegal action, default, or suspicion of committing the illegal actions.

9.5       Rabbit Selection reserve the right to use its discretion to suspend, cancel, or change the purchase order or cancel other benefits that are within the following scopes of action:

                        (1)       Suspicious or corrupted purchase order

                        (2)       Purchase order that uses the stolen information

(3)       Purchase order of several user accounts by the same customer or the same group of customers

(4)       Purchase order with the intention to resell

9.6       Rabbit Selection has the right to use its discretion to use the conditions according to Item 9.3, 9.4, and 9.5 without prior notice.

10. Warranty

In any case, the Rabbit Selection will not guarantee, certify, or act as the representative to present the user’s contents or comments, suggestions, or guarantees that are shown (whether it is clearly notified or is legally implied) in our platform, which includes your personal data that is input or transmitted to our system (if any).

 

11. Limitation of Liability

You understand clearly and agree as follows: The statements and subject matters in the platform might be incorrect in terms of contents and spellings. The reliability in the said information is your own responsibility. We reserve the right to correct the mistakes or the incompleteness in the platform whether they are in terms of contents, product details and information, and service programs. The price shown on this platform might be changed without prior notice.

The purchase order of product or service or the performance of any actions on the platform whether they are done by yourself or by one or the other persons or individuals to use your password or by other persons that stealthily use your password to order the product and service or perform any transactions whether by your own intention or from your negligence, it will be considered that the said action is complete. If the damages occur by any reason, you as the password’s owner must be responsible for the said action in all respects with no argument or any claims made to the Company to indemnify for you in any respects.

Under the terms and conditions of service on this platform, if you use the credit card of other persons to pay for products or services with no permission from the cardholder or make the payment for products or services incorrectly or not in accordance with the real intention of the cardholder or when the Rabbit Selection has received the argument from the cardholder or from the bank that issues the credit card,

causing the Rabbit Selection to not receiving the payment for products or services or unable to charge the service fee from the cardholder or from the bank that issues the credit card, you as the customer must be responsible for the price of products or services and the damages that occur in all respects and will not deprive the right of the Rabbit Selection in taking the legal actions on you.

Rabbit Selection reserves the right to revise the abovementioned terms and conditions throughout the service period. By using this platform after the revision of the said terms and agreements, it is considered that you have accepted the said revision.

12. Indemnification

The user agrees to indemnify for damages and expenses that occur from the violation of terms and conditions of service or other actions that are relevant with the user account the member due to the negligence or illegal action.

 

13. Use of Website

Rabbit Selection does not certify, guarantee, or act as the representative of any information or contents shown on the platform that might be used for the legal scope of other countries (apart from Thailand). When you enter into our platform, it is considered that you have acknowledged and presented oneself to the Rabbit Selection that you have the legal right to perform the said action and use those information in our platform.

 

14. General Provision

14.1 All Agreements: All terms of service in this platform are the complete and absolute agreement between you and the Rabbit Selection. By using this platform, you and the Rabbit Selection do not be bonded or imply representativeness, acceptance, or any promises to each other that are not shown in this place unless they are specially identified. The terms and conditions of service of our platform are  the current one and are considered to be the latest edition and will be used to replace the previous agreements and operational guarantees whether they are in writing or in words between you and the Rabbit Selection that are relevant with the use of our platform.

14.2 Modification: Rabbit Selection might revise these terms and conditions at all times. You acknowledge and agree that by visiting our platform each time, it is considered that you agree to give consent to the latest terms and conditions. Though the latest terms and conditions are not identified, the current terms and conditions must be held as important. In each visit to the platform, the latest terms and conditions must be held as important and it is your own responsibility to visit the page of the latest terms and conditions of the platform periodically to know the latest content.

14.3 Conflict: In case the terms and conditions of service in other pages that are specially specified are contradicted to the terms and conditions of this service, you must comply with the terms and conditions of service that are shown in other pages as a special case. The said terms are considered to be separated from these terms and will not affect the enforcement of the remaining agreements.

14.4 Holding of Right: Rabbit Selection has the absolute right to give, transfer, or give the right or obligation whether as a whole or some parts that are relevant with the terms of service, policies, and any relevant announcements to the representatives or the third parties.

14.5 Partial Voiding: The terms and conditions of service, policies, and any related announcements will be enforced independently. If there is one or for another term of service, policies, or announcements that cannot be enforced whether they are voided or illegal or other reasons or if any courts or jurisdictions have considered that the said terms and conditions cannot be enforced, use the remaining terms or conditions, policies, or other announcements that can be done and will be further enforced.

14.6 Applicable Law: This agreement is under the law of the Kingdom of Thailand without taking the conflicts of law into consideration. You agree that the disputes or claims that occur from or are relevant to these conditions, and agreements will be corrected under the jurisdiction of Thai court only.

 

15. Returning and Cancellation of Purchase Order

The purchase order can be cancelled if the product is not delivered. In case the product has been delivered, you cannot cancel the said purchase order. The request for refunding after the purchase order is made and the product is received will be considered case by case. Generally, we do not have the refund policy, unless it is there is an abnormality in the purchase order. However, we will try to protect the benefits for the members to the best.

 

16. Payment Policy

You can pay for products and services (if any) that are ordered from the platform via credit card or debit card or pay via mobile banking system of various banks specified below by which the payment must be made within 8 hours after making the payment when choosing to pay via the abovementioned methods.  Hence, the system will check your payment automatically and approve the purse of product and will deliver the product when the payment is fully made only.

Note:

• For the expenses or the transfer fees, the transferor/customer is the responsible person for the said fee. The Bank will use 1 working day to summarize your payment balance.

• In case you order the product that needs to be installed and the said product does not include the installation fee, there will be the additional installation fee which you must pay to the staff.

 

17. Empty Cart Policy (or Pushcart)

The product that you have put in the cart (pushcart) will be deleted automatically when the product is deleted from the list of products that are sold on the platform due to the need to update the product information and the product price for you to receive the information that is the most correct, accurate, and true to the fact as much as possible.
